Terms of Service

These Terms are an agreement between you and [LEGAL ENTITY NAME] ("DearSanta.si", "we"). By placing an order, you agree to them.

1. Who can order

You must be 18 or older and the parent or legal guardian of any child you name in an order, or have that parent's permission. Children may not use this site or place orders.

2. What you're buying

A digital, personalized product:

Prices are in US dollars and include any applicable fees. Sales tax is added where required. Nothing physical is shipped.

3. How it's made: AI disclosure

Our Santa is an original, AI-animated character with a synthetic voice. He is not a real person or actor, and he is not affiliated with any film, brand, retailer, or public figure. Scripts are assembled from templates written by us and personalized with the details you provide. Santa never promises a specific gift.

4. Your content

You are responsible for the details you submit. Don't include anything unlawful, hateful, sexual, violent, or anyone's private information, such as a full name, address, school, or contact details. We may refuse or refund any order we think is inappropriate. You give us a limited license to use what you submit solely to produce and deliver your order.

5. Delivery

We email a private download link, usually within an hour and in any case within 24 hours of payment. Peak periods (December 20–25) may be slower. Please download your files promptly: for privacy, files are deleted 14 days after delivery. We are not able to recover deleted files. Please check the email address you enter, because we can't redeliver to a mistyped address once your details are deleted.

6. License to the finished product

You may download, keep, print, and share your video, letter, and certificate for personal, non-commercial use, including posting on your personal social media. You may not resell them, use them in advertising, or use our Santa character or brand for other purposes. We keep all rights in our character, templates, artwork, and brand.

8. Disclaimers

The service is provided "as is." We work hard on quality, but AI-generated video can contain small imperfections, such as mispronunciations. If something is wrong, tell us and we'll redo it or refund you (see the Refund Policy). To the maximum extent the law permits, we disclaim implied warranties.

9. Limitation of liability

To the maximum extent the law permits, our total liability for any claim relating to an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential damages. Some jurisdictions don't allow these limits, so they may not apply to you.

10. Privacy

Our Privacy Policy explains what we collect and how quickly we delete it.

11. Governing law and disputes
